Terms and Conditions of Service
This document constitutes a legally binding agreement between Horn and Horn Renovations (Pty) Ltd (hereinafter referred to as "The Company," "we," "us," or "our") and the client (hereinafter referred to as "The Client," "you," or "your"). By accepting a quotation and engaging our services, you agree to be bound by these Terms and Conditions.
1. Scope of Work and Services
1.1. Services: The Company specialises in solar panel cleaning and interior and exterior painting for residential, commercial, and industrial buildings. The specific services to be rendered will be as detailed in the accepted quotation or invoice.
1.2. Quotations/Estimates: All quotations/estimates provided by The Company are valid for a period of 7 calendar days from the date of issue. Prices quoted are based on the information and access provided at the time of the site assessment or initial communication. Any changes to the scope of work, including but not limited to additional services, materials, or unforeseen site conditions, may result in an adjustment to the final price.
2. Client's Responsibilities
2.1. Access and Utilities: The Client shall provide The Company with safe and unhindered access to the property and work areas during the agreed-upon working hours. The Client must also ensure the availability of necessary utilities, including a suitable water supply and electricity, for the duration of the project.
2.2. Site Preparation: For painting services, The Client is responsible for removing all valuables, breakables, and furniture from the work area unless otherwise agreed upon in writing. The Company will take reasonable care to protect the surrounding area but is not liable for any damage to items not removed.
2.3. Pre-existing Conditions: The Client must inform The Company of any known pre-existing conditions that may affect the work, such as unstable surfaces, previous repairs, or faulty electrical wiring. Failure to do so may affect the final outcome and could lead to additional costs.
3. Payment
3.1. Payment Terms: A deposit, as specified in the quotation, is required to secure the booking and commence work. The outstanding balance is due upon completion of the work and presentation of the final invoice.
3.2. Late Payment: The Company reserves the right to charge interest on any overdue amount at a rate of 2% per month or the maximum rate permitted by law, calculated from the date of the invoice until payment is received in full.
3.3. Non-Payment: In the event of non-payment, The Company reserves the right to suspend all services until the outstanding amount is settled and may institute legal proceedings for the recovery of the debt, with all associated legal costs being for The Client's account.
4. Cancellations and Postponements
4.1. Cancellations by The Client: If The Client cancels a confirmed booking less than 48 hours before the scheduled start time, The Company may retain the full deposit as a cancellation fee, alternatively reserve the right to charge a cancellation fee.
4.2. Postponements: Any request to postpone a project must be made in writing. The Company reserves the right to charge a fee for postponements if materials or labour have already been secured.
5. Liability and Indemnity
5.1. Limitation of Liability: While The Company takes all reasonable care and skill in performing its services, it shall not be liable for any direct, indirect, special, or consequential damages, including loss of profit or revenue, arising out of or in connection with the services provided, except where such damage is caused by the gross negligence or wilful misconduct of The Company.
5.2. Solar Panel Cleaning: The Company is not responsible for the performance or efficiency of solar panels after cleaning. Our guarantee is limited to the physical removal of dirt and debris.
5.3. Indemnity: The Client indemnifies and holds harmless The Company from and against any and all claims, damages, liabilities, and expenses (including legal fees) arising from the Client's breach of these Terms and Conditions or from any negligent or wrongful act or omission by The Client.
6. Warranties and Guarantees
6.1. Workmanship: The Company warrants that all services will be performed in a professional and workmanlike manner.
6.2. Painting: Our warranty on painting services is limited to issues of peeling, blistering, or flaking caused by faulty workmanship. This warranty does not cover:
· Fading or discolouration due to UV exposure or environmental factors.
· Cracks or blistering caused by structural movement or moisture from within the building.
· Damage to paint caused by The Client or third parties.
7. Governing Law
7.1. These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from this agreement shall be subject to the exclusive jurisdiction of the South African courts.
8. General
8.1. Entire Agreement: This document, together with the accepted quotation, constitutes the entire agreement between The Company and The Client and supersedes all prior agreements or understandings, whether written or oral.
8.2. Amendments: No amendment, variation, or waiver of any provision of these Terms and Conditions shall be effective unless made in writing and signed by both parties.
